1. About these Terms

These Terms & Conditions ("Terms") govern your use of the Bids9 website and web app (the "Platform"), operated by [Legal entity name][To confirm] ("Bids9", "we", "us"), with its office at 754, Saurashtra Society, Ramnath Bhavan, Sector-5, Gandhidham (Kutch) 370201, Gujarat, India.

By creating an account, unlocking a vehicle or placing a bid you agree to these Terms, the Privacy Policy, the Refund & Cancellation Policy, the Fees & Pricing page, the Vehicle Pickup Policy and the Rulebook. If you do not agree, do not use the Platform.

2. What Bids9 is — a marketplace

Bids9 is an online marketplace where insurance companies and their authorised representatives ("Insurers" or "Sellers") offer salvage, total-loss and recovered vehicles for sale by online auction to verified buyers ("Bidders").

The Insurer is the seller of every vehicle. Bids9 is not the seller, owner, agent or bailee of any vehicle and does not take possession of vehicles.
The winning Bidder pays the vehicle price directly to the Insurer. Bids9 never collects, holds or transfers money for a vehicle.
Bids9 earns only the entry fee a Bidder pays to unlock bidding on a vehicle (see Fees & Pricing

2. What Bids9 is — a marketplace

The Insurer is the seller of every vehicle. Bids9 is not the seller, owner, agent or bailee of any vehicle and does not take possession of vehicles.

The winning Bidder pays the vehicle price directly to the Insurer. Bids9 never collects, holds or transfers money for a vehicle.

Bids9 earns only the entry fee a Bidder pays to unlock bidding on a vehicle (see Fees & Pricing

6. Bidding rules

Every bid is final and binding. A bid cannot be withdrawn or reduced once placed. By bidding you make an offer to buy the vehicle at that amount, which becomes a binding contract with the Insurer if the Insurer approves it (clause 7).

Bids must meet the minimum increment shown on screen. The order of bids is decided by our servers; the time a bid is received by us, not when you tapped, decides its place.

A max bid (automatic bid) lets the system bid for you, one increment at a time, up to the amount you set. It can be raised but not lowered. If two max bids are equal, the earlier one wins.

Soft close: a bid placed in the final 2 minutes extends the closing time by 2 minutes, so no one wins by bidding in the last second. Extensions are capped (at 30 per vehicle)[To confirm].

Every sale is subject to the Insurer’s approval. When bidding closes, the top bid is "Under approval": it is not a sale yet. The Insurer approves or declines it within 24 hours of the close; without an approval in that time the vehicle closes unsold. No vehicle is ever sold automatically.

Vehicles may carry a hidden reserve price set by the Insurer. The Insurer may approve a top bid below its reserve, or decline one at or above it; either way the decision is the Insurer’s.

Bids9 may record an approval or a decline on the Insurer’s behalf only on the Insurer’s instruction, and keeps a record of who gave the instruction, when, and a note.

Admin-approved price. On the Insurer’s instruction, Bids9 may approve the sale at a price different from your top bid, with the reason. That price binds you only if you accept it on the Platform within the time shown (24 hours by default)[To confirm]. If you decline or do not answer, there is no sale, nothing is owed and it does not count against you; the vehicle may then be offered to the next-highest Bidder at that Bidder’s own highest bid, or relisted. Bids9 never holds you to a price you did not bid or accept.

Shill bidding, bidding on your own or a connected party’s vehicle, collusion between Bidders, using more than one account, automated or scripted bidding, and attempts to interfere with the Platform are prohibited and may lead to an immediate permanent ban and reporting to the authorities.
